Which states have a used car lemon law?

Most state lemon laws are written for new cars. Some cover used cars in set cases, often while a factory warranty still runs. Tap a state for its full rules.

When a used car counts

In California, a used car with a maker's new-car warranty issued at the sale is covered, per the state Attorney General. Leftover factory warranty alone is not enough.

Every used car on a dealer lot must carry a Buyers Guide sticker under the FTC Used Car Rule. It says whether the car has a warranty or is sold "as is". The FTC says it "will override anything in your sales contract."

New in California: a 3-day cancel right

California's CARS Act took effect on October 1, 2026. Buyers of a used car priced at $50,000 or less get a three-day right to cancel a dealer sale, per the California DMV. Mileage limits and a restocking fee can apply.

The federal warranty route works everywhere

Can I sue a dealership for selling me a lemon used car?

Often yes, if the car came with a written warranty or the dealer misled you. The federal warranty law lets an owner who wins recover attorney fees. See dealer fraud.

Does lemon law apply to a private sale?

Rarely. A private seller gives no warranty in most sales. A dealer sale with a warranty is a much stronger case.

What does "as is" mean on a used car?

It means the dealer will not pay for repairs after the sale. Some states ban "as is" sales, and those dealers post a different Buyers Guide.
