What the Magnuson-Moss Warranty Act covers

The Magnuson-Moss Warranty Act covers any consumer product sold with a written warranty, cars included. Written warranties on products that cost more than $15 must be available to read before you buy, the FTC guide says.

A seller who gives a written warranty cannot also cancel the implied warranties. The same holds when the seller sells you a service contract.

It pays your attorney

The law lets owners recover "court costs and reasonable attorneys' fees", per the FTC. The rule itself is 15 U.S.C. 2310. So the review is free and there is no fee unless you win.

How it differs from state lemon law

State lemon laws count repair visits and days in the shop. The federal law asks a looser question: did the maker fix the car after a reasonable number of tries? Under a "full" warranty, the owner then picks "either a replacement or a full refund."

Yes, when the used car comes with a written warranty or a service contract. A car sold "as is" with no warranty is usually not covered.

What are its limits?

It does not force anyone to offer a warranty, and it sets no repair count. The seller gets a fair chance to fix the car first.

How is a Magnuson-Moss claim filed?
